Terms of Service

Last updated: October 16, 2026

Who we are

The Call AI service (callai.live) is operated by KiwiAI. Support: [email protected] · Privacy: [email protected]

1. General

Call AI (the "Service", the "Platform") is an AI Contact Center platform that enables businesses to operate AI voice agents, SMS / WhatsApp messaging, and automated marketing and sales activity. By using the Service you agree to these Terms and to all applicable laws, including (but not limited to):

  • Israeli Communications Act, 1982 (including §30A — anti-spam)
  • Israeli Privacy Protection Act, 1981
  • Israeli Consumer Protection Act, 1981
  • EU GDPR (Regulation 2016/679) for EU customers
  • U.S. TCPA (Telephone Consumer Protection Act) for U.S. activity

2. Acceptable Use Policy (AUP)

Call AI is a business AI communication platform — it is not a virtual companion service, an entertainment product, or an adult-content platform. You may NOT use the Service for any of the following:

  • Marketing or promotional outreach to recipients without explicit prior opt-in
  • Calls or messages to numbers on a DNC ("Do Not Call") list
  • Voice cloning of any individual without their explicit written consent
  • Fraud, impersonation, misrepresentation, deception, or scams
  • Offensive, threatening, politically extreme, racist, or unlawful content
  • Sexually explicit content, sexting, "AI girlfriend / boyfriend", virtual romantic companion bots — the platform is not intended for and will not allow this.
  • RED LINE: any sexual, violent, or exploitative content involving minors (under 18) — including "ageplay" — is absolutely prohibited and will be reported to authorities.
  • Harassment, stalking, threat, blackmail, or "doxxing" bots
  • Impersonating a licensed professional (doctor, lawyer, financial advisor, psychologist, pharmacist) or presenting the conversation as a human conversation without disclosing it is AI
  • Encouragement of self-harm, suicide, or eating disorders
  • Activity that violates the terms of upstream providers (Meta, Twilio, Telnyx, Cardcom, OpenAI, Anthropic, etc.)
  • Outreach outside permitted hours in the recipient's jurisdiction (Quiet Hours / TCPA)
  • Attempts to circumvent quotas, rate limits, or security controls
  • Aggressive automation or load-testing without prior coordination
  • Reselling the Service or bundling it for third parties without a White-Label license

Violation will result in immediate suspension without notice, with no refund of unused balance. Customer remains liable for any civil, criminal, or regulatory consequences and shall indemnify Call AI per Section 8.

Repeat infringer policy: Accounts that accumulate substantiated complaints for copyright infringement or unauthorised outreach (spam) receive "strikes". Three strikes within twelve months result in permanent termination and IP-level block. Takedown procedure is described on the DMCA page.

3. Recordings, Privacy, and PII

The Service records calls for quality control and legal defense in case of dispute. We do not use call recordings to train AI models. A recording disclosure is played to the recipient at the start of the call, and every outbound AI call begins with a disclosure that the caller is an AI. Recordings are retained for 90 days and then auto-deleted; transcripts are deleted together with them. Data subjects may request earlier deletion at any time.

The Platform automatically detects and redacts (PII redaction) credit card numbers, CVV, and Israeli national ID numbers from call transcripts. The AI is not authorized to ask the recipient to read out card details by voice — payment transactions are processed exclusively via secure hosted-checkout links provided by a PCI-DSS Level 1 processor.

4. AI Accuracy & Generated Content

AI systems can produce inaccurate, fabricated ("hallucinated"), or off-script output. Customer is responsible for reviewing, approving, and supervising AI agent content before deployment. Call AI does not warrant accuracy of AI output, business outcomes, or conversion metrics. Customer is expected to review scripts and apply human oversight on high-stakes calls.

5. VAT and Taxation

Service prices include 18% Israeli VAT for Israeli residents (effective Jan 1, 2025), per Israeli VAT law. Non-Israeli customers are billed at 0% VAT — customer is responsible for self-assessing applicable taxes (Reverse Charge). Residence is determined via cross-checking billing address, card BIN, and signup IP country (the 2-of-3 rule).

6. Billing, Cancellation & Refunds

The Service operates on a hybrid model: a monthly subscription granting an included minute allowance and unlocking features, plus a top-up credit wallet for overage usage. All usage is billed at published rates.

Platform payments are processed by Cardcom (an Israeli card processor) in a secure in-page payment window; tax invoices are issued via EZcount.

Cancelling a subscription: Billing page → "Cancel subscription". Cancellation stops renewal; the service keeps running until the end of the paid period, and a confirmation email is sent. Closing the account: Billing page → "Close account" (accounts without a paid plan close immediately; paid plans run until the end of the paid period). Data is deleted within 30 days after the paid period ends, except records the law requires us to keep (invoices: 7 years).

You may cancel a purchase within 14 days of the purchase under Israeli Consumer Protection law and request a refund from the Billing page or by email to [email protected]. Refunds are processed within 14 days, less a cancellation fee of up to 5% or ₪100, whichever is lower.

Customers SUSPENDED for AUP violations are not entitled to refunds.

7. Data Subject Rights (GDPR / Israeli Privacy Act)

Customer and call recipients are entitled to the following rights:

  • Access — receive a copy of all retained data
  • Rectification — correct inaccurate data
  • Erasure — request full deletion, subject to statutory retention
  • Portability — receive data in a structured format, on request by email to [email protected]
  • Objection — object to marketing processing

Requests should be sent to [email protected] and will be handled within 30 business days.

8. Indemnification

Customer agrees to indemnify, defend, and hold harmless Call AI, its employees, directors, and service providers from any claim, demand, damage, loss, liability, cost, or expense (including reasonable attorneys' fees) arising from: (a) Customer's use of the Service in violation of these Terms; (b) violation of the AUP; (c) violation of applicable law; (d) infringement of third-party rights; (e) content Customer submitted to the Platform.

9. Limitation of Liability

The Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including (without limitation) merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. Call AI does not warrant 100% uptime, any specific call quality, AI throughput, or business outcomes.

In any event and on any cause of action (whether in contract, tort, negligence, or otherwise), Call AI's total cumulative liability to Customer shall not exceed the amount Customer paid in the twelve (12) months preceding the event. Call AI shall not be liable for any consequential, special, indirect, incidental, or punitive damages — including lost profits, lost opportunity, lost goodwill, or lost data — even if advised of the possibility of such damages.

10. Force Majeure

Call AI shall not be liable for delay or non-performance caused by circumstances beyond its reasonable control, including (without limitation) power or internet outages, downstream provider outages (Telnyx, Twilio, Cardcom, Cloudflare, etc.), acts of war, pandemics, government regulation, or natural disasters.

11. Changes to These Terms

Call AI may update these Terms from time to time. Material changes will be communicated via the email on file at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

12. Entire Agreement; No Waiver

These Terms, together with the Privacy Policy and any linked agreements, constitute the entire agreement between the parties and supersede any prior agreement. Failure to enforce a right is not a waiver. If any provision is held invalid or unenforceable, the remainder shall remain in effect.

13. Governing Law

These Terms are governed exclusively by the laws of the State of Israel, excluding its conflict-of-laws rules. Exclusive jurisdiction lies with the competent courts of Tel Aviv-Yafo. The parties may agree in writing to refer a dispute to arbitration under the Israeli Arbitration Law (5728-1968) in lieu of court proceedings, particularly for B2B commercial disputes.

14. Additional Provisions

14.1 Minimum age

The Service is intended for businesses. Use is permitted only from age 16; minors under 18 require written parental / guardian consent. Use of the Service to contact minors without parental consent is prohibited.

14.2 Third-party dependencies

The Service depends on third-party infrastructure — Meta (WhatsApp), Twilio, Telnyx, Cardcom, EZcount, OpenAI, Anthropic, Google, Cloudflare (full list in the Privacy Policy). Stripe is used only if a Customer connects their own Stripe account for payment links to their own clients. Call AI is not liable for downtime, account suspensions at upstream providers, API or policy changes, or service discontinuation by them. Provider terms override this Agreement (e.g. Meta WhatsApp Business policies — violation causes suspension).

14.3 Refund policy

Consumed credits (call minutes, messages, AI calls) are non-refundable and final. You may cancel a purchase within 14 days of the purchase and request a refund from the Billing page or by email to [email protected]; refunds are processed within 14 days, less a cancellation fee of up to 5% or ₪100, whichever is lower. AUP violations or customer-initiated chargebacks void any refund eligibility. Partially-delivered digital services are deemed consumed.

14.4 AI accuracy and customer responsibility

AI agents may err, fabricate information (hallucinate), or deviate from instructions. The Customer is responsible for reviewing and approving outputs before commercial use, transmission to end customers, or business decisions. Call AI does not warrant accuracy or fitness for any particular purpose.

14.5 No professional advice

The Service does not provide medical, legal, financial, psychological, tax, or any other licensed professional advice. The agent will not represent itself as a licensed professional — an automatic moderation layer enforces this. Any output of an advisory nature is general information only; do not rely on it without consulting a licensed professional.

14.6 Export control and sanctions

The Service may not be used from or to contact residents of countries subject to OFAC sanctions (Iran, North Korea, Syria, Cuba, the Crimea / Donetsk / Luhansk regions) or sanctions lists of Israel / the UN / the EU. Engagement with designated terrorist entities or SDN-listed individuals is prohibited.

14.7 Backups

Call AI maintains operational backups, but Customer is responsible for backing up critical data (contact lists, important recordings); a data export can be requested by email to [email protected]. Data loss from provider failure or human error does not entitle Customer to compensation beyond the cap in Section 8.

14.8 Beta features

Features marked "Beta" or "Preview" are provided "AS IS" without SLA, without availability warranty, and may break or be removed without prior notice.

14.9 Generated content ownership

Customer owns (a) agent prompts, contact lists, and uploaded content; (b) AI outputs generated for them (summaries, transcripts, email drafts, etc.) — subject to model-provider output licenses (Anthropic, OpenAI, Google). Call AI retains a limited, non-exclusive license to process content for service delivery, quality monitoring, and aggregated-anonymous reporting only.

14.10 Trademarks

"Meta", "WhatsApp", "Twilio", "Telnyx", "Stripe", "OpenAI", "Anthropic", "Google", and their logos are registered marks of their respective owners. Their use within the Call AI platform does not imply partnership, endorsement, or formal support.

14.11 API usage

API usage is subject to rate limits published in the Docs. Prohibited: scraping, reselling API calls, reverse-engineering, or volumes intended to overload the servers. Violations result in immediate API-key suspension.

14.12 Law-enforcement requests

Call AI complies with court orders and lawful requests from competent authorities. As a rule, we attempt to notify the Customer before disclosing information — unless a gag order or legal urgency applies. Service of process: [email protected].
